One of the most common practices in the City of Baltimore is ground rent. In real estate terms, this means you can rent or lease a ground for a particular number of years and construct your dwelling there. It is possible to purchase the ground if you do not own the ground rent.
About Ground Rent
This system started in the 18th century. In order to keep the cost low, buyers just had to spend on the building and pay a fixed rent towards the land. Ground rent fee is paid by those who own the building on the property, which ranges from $50 to $150 depending on the area and location. This fee is usually paid twice a year.
Present Ground Rent Registry in Maryland
If you are paying ground rent in Maryland after the year 2007, you must register with their new database. You must register on the database which is maintained by the Department of Assessment and Taxation, Maryland before September 30th 2010.
Ground Rent Notices
Owners of ground rent, according to latest notices must provide details regarding the property to home owners who may be interested in purchasing or redeeming the ground rent. Redeeming can be done as a part of property refinancing or initial financing.
If you lose your Ground Rent Holders
If you are in a property as a ground rent owner and are unable to locate the land owner, you are still answerable to the mortgage company to escrow the fee amount. Pending ground rent can be collected for up to three years. For instance, if you are a ground rent resident for the past ten years and your land owner asks you for payment all of a sudden, they can collect only up to three years of pending rent.
They must also first prove their property title. If you have ignored payment demands, you must pay overdue rent charges. Ground rent holders may charge $700 as attorney fees, $500 for non payment and $300 for title search.
Ground Rent default
If there is a default, ground rent owners can opt to go in for a lien in order to clear their dues to the property owner. Foreclosure rules are similar to that of banks in case of mortgage default.
Purchasing Your Ground Rent
Property owners can sell the property to the ground rent owners at rates fixed by the law of Maryland. Rates of redemption are calculated based on the year lease was created. There is a nominal legal paper filing fee involved which the ground rent owner has to bear.
If you want lease redemption but are unable to locate the property owner for three years, you can do so with the help of Maryland Department of Assessment and Taxation. You can apply for the same at www.dat.state.md.us/sdatweb/ground_rent.html.
If Ground rent is unaffordable
You can opt for loan financing offered by the Department of Housing and Community Development, Maryland to redeem ground rent you cannot afford.
